These Terms of Service (“Terms”) govern your use of the website at https://tenderprostaffing.com and related candidate and recruiter portals operated by TenderPro Staffing (“TenderPro”, “we”, “us”, or “our”). By using our services, you agree to these Terms.

1. Who we are

TenderPro Staffing is a Texas-based healthcare staffing agency. We connect nurses, allied health professionals, and other healthcare workers with hospitals and care facilities for per-diem, contract, travel, and direct-hire positions.

2. Eligibility

You must be at least 18 years old, have the legal right to work in the United States (or in any jurisdiction where you seek placement through us), and provide accurate information to use our services.

3. Your account

You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials. Notify us promptly if you believe your account has been accessed without authorization.

4. Acceptable use

You agree not to:

• Provide false, misleading, or fraudulent information, including in your application or credentials.
• Impersonate another person or entity.
• Interfere with the operation of our website or portals.
• Use our services to send spam or solicit other candidates outside of our platform.
• Use any automated means (bots, scrapers) to access our services without our written permission.

5. SMS communications

Your use of SMS communications with us is governed by the SMS section of our Privacy Policy, available at https://tenderprostaffing.com/privacy-policy. Consent is opt-in only, you can reply STOP at any time, and we do not share your phone number or SMS opt-in data with third parties for marketing.

6. Placements and employment

TenderPro provides staffing and recruiting services. Where we place you, your employment relationship may be with TenderPro, with the facility, or with another employer of record, depending on the engagement. The specific terms of any engagement will be documented separately.

7. Intellectual property

The website, portals, and all related content are owned by TenderPro or our licensors and are protected by copyright and other laws. You may not copy, modify, or redistribute our content except as permitted by these Terms or applicable law.

8. Third-party services

Our services rely on third-party providers, including Twilio (SMS), Supabase (database hosting), and similar vendors. We are not responsible for the acts or omissions of these third parties, but we work with reputable providers and require appropriate data-handling commitments from them.

9. Disclaimers

The services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee that you will be placed in any specific position or that any specific shift will be available.

10. Limitation of liability

To the fullest extent permitted by law, TenderPro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of our services. Our total liability for any claim arising from or related to these Terms or our services will not exceed the greater of (a) the fees you have paid us in the 12 months before the claim, or (b) one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless TenderPro and our affiliates from any claims arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right.

12. Termination

We may suspend or terminate your access to our services at any time if you violate these Terms or for any other reason in our reasonable discretion. You may stop using our services at any time.

13. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. Continued use of our services after changes take effect means you accept the updated Terms.
